According to Roscoe Pound- “Law must be stable, and yet it cannot stand still”.

  • It is to be noted that “change” is the law of nature and “law” is no exception to it.
  • The growth of law begins with the growth of society and in the 20th and 21st century, the scientific and technological developments are transforming the society at an increasing rate. Thus, the vital question is “Can law keep pace with life”?, This dynamism and stability is very imperative because law plays an imperative function, that is, “Solving the problems of the Society”.
  • Dynamism in International Law- Aptly remarked by Soviet Authors, International Law is not static, it is constantly developing, and sometimes it does not keep up with developments and in other times it anticipates them.
  • Example 1– Some major changes-> The United Nations Environment Programme (UNEP) with a view to warn people of the increasing temperature of earth due to green house effect gave the slogan “Global Warming; Global Warming”.
  • Example 2– At the 1992 Earth Summit, held at Rio De Janeiro, undertook to save the planet earth from “Environmental Crisis”.1
  • Example 3– Establishment of World Trade Organization (estd. 1st January 1995), International Criminal Court (ICC) (estd. 1 July 2002) are some of the revolutionary changes in the International Law.
